The chairman Dr. Manthei called the meeting to order at 9:05 AM. Present: Dr. Manthei - Chairman, Dr. Daitch - Member, Dr. Schreiber - Member, Dr. Bannister-Member, Sara Price, Esq. Assistant Attorney General, Wauna
Selleck, Dr. Tarno – Executive Director, Mr. Kersey-Member, and John Delap, III.
II Minutes
The minutes of the January 15, 1999 meeting were mailed previously to each member. Mr. Kersey made a motion to accept the minutes. Dr. Bannister seconded the motion. There were no major corrections and the motion passed.
III Election of Officers:
President (Chairman) – Mr. Kersey moved to retain Dr. Manthei as President. Dr. Daitch seconded and the motion passed 4-0 with Dr. Manthei abstaining. Vice-President – Mr. Kersey moved to retain Dr. Schreiber as Vice-President of the board. Dr. Manthei seconded. The motion passed 4-0 with Dr. Schreiber abstaining. Secretary/Treasurer – Dr. Bannister made a motion to retain Mr. Kersey as Secretary/Treasurer. Dr. Daitch seconded and the motion passed 4 – 0 with Mr. Kersey abstaining.
IV Financial Report:
Dr. Tarno reported of the financial condition of the board. Expenditures through April 17, 2000 for the fiscal year starting July 1, 1999 are $45,391 with $11,600 projected expenses to the end of June. That would equal less than $60,000 spent to operate the board for the year compared to $69,000 in FY 1998-1999. Projected income for the year is estimated at over $64,000. This would mean the board would be in the black for the fiscal year. This would leave a projected balance of about $109,000 in the bank account. Dr. Tarno will have final (unaudited) figures at the next meeting.
V Investigative Report:
There were no cases to report from the northern part of the state per Dr. Bannister. There were no cases to report from the South – Dr. Daitch. Sara Price, Esq., reported that there are three cases that the Attorney General’s office is working on with one close to hearing.
Legal Report:
Sara Price, Esq., reported that a new person has been hired to replace her.
VII FSMB Medical Guidelines for the use of controlled substances for the treatment
There was discussion of the topic but no action was tabled.
+VII Executive Directors Report:
A. A malpractice action was reported B. Mr. Kersey reported on his attendance at the FSMB House of Delegates Meeting.
He reported on some sentiment towards a national licensing movement being supported by the Military, HMO’s, and big government. He also reported on more and more states starting to profile doctors because of pressure from the public. Apparently a suggestion was made that if a state legislature mandated this that it should not be done without money from the state.
C. Nevada Health Professionals Assistance Foundation. Dr. Tarno reported that
$1500 had been donated to the foundation by this board matched by NOMA.
D. Discussion of the proposed SB 199 from last legislative session. Sara Price was
concerned about some of the wording in the proposed changes to NRS 633 in the original draft of SB 199. She volunteered to correct those areas. The entire proposed changes must be received by the Executive Department by May 1st.
VIII Sheldon Stein, D.O.:
Dr. Stein requested to appear at the meeting to discuss the board’s position concerning Internet prescribing. Mr. Newman representing Dr. Stein’s practice described their intention to prescribe based on having records on a patient in their files and only after assurance of a physician’s exam. The board did not take action or agree on a policy statement regarding this situation. The board members did express concern that prescribing should be done by a licensed physician and that patient records be accessible by the prescribing physician.
